Terms of sale

1. About us and these terms

1.1 Nutrient Warrior is a trading name of Stuart James Rex, a sole trader based in the United Kingdom. Our address is 119 Harnham Road, Salisbury, SP2 8JN and you can contact us at [email protected].

1.2 These terms apply when you buy a meal plan or subscription from us, whether through our website, a link on Instagram or other social media, or an invoice. Please read them before you pay. By ticking the box at checkout and paying, you agree to them.

1.3 In these terms, "we", "us" and "our" mean Nutrient Warrior, and "you" means the person buying. You must be buying as a consumer for your own use, unless we have agreed otherwise in writing (for example, a coach buying plans for clients by invoice).

1.4 We may update these terms from time to time. The version that applies to your order is the one shown when you paid. We will tell subscribers about changes by email at least 30 days before they take effect, and you can cancel if you do not agree.

2. What we provide and what it costs

2.1 We create personalised meal plans based on the information you give us in our intake form. Each plan package includes a 7-day meal plan with recipes (PDF), a shopping list and a tracker spreadsheet, built to calorie and protein targets we calculate from your answers.

2.2 We offer:

2.3 Prices are in pounds sterling and include everything you pay. We are not currently registered for VAT, so no VAT is charged. Any change to the subscription price will be emailed to you at least 30 days before it applies.

2.4 Delivery. We will email your first plan within 48 hours of receiving your completed intake form. On a subscription, each new plan is then sent 7 days after the one before, and once a month we will email you a short check-in form so we can update your targets. If you don't complete a check-in, we will keep building your plans from your latest answers. We cannot start your plan until you complete the intake form, so please do this straight after paying.

2.5 If your plan is late. If we have not emailed your plan within 48 hours of receiving your completed intake form, you can cancel and get a full refund at any time until it arrives. Email us to do this.

2.6 Plans are delivered digitally by email. Please check your spam folder and tell us within 7 days if a plan has not arrived.

3. Who our plans are for, and health

3.1 Our plans are for healthy adults aged 18 or over. They are general nutrition guidance, not medical advice, diagnosis or treatment, and we are not doctors, registered dietitians or registered nutritionists.

3.2 Our plans are not suitable if you:

• are under 18
• are pregnant or breastfeeding
• have, or have had, an eating disorder
• have diabetes treated with medication, kidney or liver disease, or another condition affecting what you can eat
• take medication that interacts with diet (for example warfarin or MAOIs)
• have a BMI under 18.5

3.3 If any of these apply, or you are unsure, please speak to your GP before buying. If you tell us at checkout or in the intake form that any of them apply, we will not create a plan and will give you a full refund, as set out in section 6.5.

3.4 Before making significant changes to your diet or activity, we recommend you speak to your GP, especially if you have any health concerns. Stop following the plan and seek medical advice if you feel unwell.

3.5 Allergies. Tell us about allergies and intolerances in the intake form. We will avoid ingredients you list, but you must always check product labels, as recipes and brands change. We cannot guarantee any meal is free from allergens.

3.6 Results. Results vary from person to person and depend on many things outside our control. We do not promise any particular amount of weight loss, muscle gain or other result.

4. Ordering and payment

4.1 Payments are processed securely by Stripe. We never see or store your full card details. Our contract with you starts when your payment is confirmed and we email your receipt.

4.2 We may refuse or cancel an order, with a full refund, if we cannot provide a safe plan for you (see section 3), if the information you give is incomplete, or if we suspect fraud.

5. Subscriptions

5.1 Nutrient Warrior Monthly renews automatically every month on the date you first paid, and your card is charged £29 each time until you cancel.

5.2 You can cancel at any time, online, through the "manage subscription" link in your receipt email or at billing.stripe.com/p/login/4gMeVd9iN0QF3o372r9k400, or by emailing us. Cancelling stops future payments. You keep receiving weekly plans until the end of the month you have already paid for, and there is no charge after that.

5.3 We do not refund part-months once a month has started, except where the law requires it or section 6 applies.

5.4 If a payment fails. Stripe will retry the payment and email you a link to update your card. We do not send any further plans until the payment goes through. Once it does, we send the plan we held back and carry on every 7 days, so you do not lose any weeks you have paid for. If the payment still hasn't gone through after Stripe's final retry, your subscription is marked as unpaid and no further payments are taken until you update your card or cancel.

5.5 If you haven't completed your intake form. If you subscribe but have not completed the intake form within 14 days of paying, we will email you and pause your subscription so you are not charged again. If you would rather cancel, we will refund your first payment in full, because no plans have been delivered.

5.6 We may end a subscription by giving you at least 30 days' notice by email, or immediately if you break these terms in a serious way. If we end it for any reason other than your breach, we will refund any payment covering plans we have not delivered.

6. Your right to cancel, and refunds

6.1 14-day cooling-off period. As a consumer, you normally have 14 days from the day you pay to change your mind and cancel, for a full refund.

6.2 Starting straight away. Because your plan is personalised and sent digitally, at checkout we ask you to confirm that you want us to start straight away and that you understand you lose your right to cancel once your plan has been delivered. We confirm your choice in writing by email. This means:

• Before your plan is delivered, you can cancel and get a full refund.
• Once your plan has been delivered, you cannot cancel that plan under the cooling-off rules.
• For subscriptions, if you cancel within the first 14 days, we will refund that month's payment minus £6.70 for each weekly plan already delivered. £6.70 is the weekly cost of the subscription (£29 a month over a year, divided by 52 weeks).

6.3 How to cancel. Email [email protected] with your name and the email you used to pay, saying you wish to cancel. You do not have to give a reason. We will refund you within 14 days, to the card you paid with.

6.4 If something is wrong. Your legal rights under the Consumer Rights Act 2015 are not affected. If a plan is not as described, does not match the targets and preferences you gave us, or has a mistake, tell us within 14 days of receiving it. We will correct or replace it free of charge, and if we cannot, we will refund you.

6.5 If our plans aren't suitable for you. If you tell us at checkout or in the intake form that any of the conditions in section 3.2 apply, we will not create a plan and we will refund you in full within 14 days, to the card you paid with. For a subscription, we will also cancel it so you are not charged again.

6.6 We may also offer refunds at our discretion in other situations.

7. Your responsibilities

7.1 Give us accurate, complete and honest information in the intake form, and tell us if your health, weight, goals or allergies change. Your plan is only as good as the information you give us.

7.2 Plans are for your personal use only. Please do not share, resell or publish them.

8. Our responsibility to you

8.1 We will provide our services with reasonable care and skill, as the law requires.

8.2 We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for losses caused by inaccurate information you gave us, by not following section 3, or by allergens in products you buy.

8.3 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

8.4 Apart from section 8.3, our total liability to you for any order is limited to the amount you paid us in the 12 months before the claim.

9. Intellectual property

9.1 We own the copyright in our plans, recipes, designs and materials. You may download and print them for your own personal use.

10. Reviews and testimonials

10.1 If you share feedback, before-and-after photos or results with us, we will only publish them with your written permission, and you can withdraw that permission at any time.

11. Your personal data

11.1 To build your plan we collect health-related information, such as weight, height, activity and goals, which is special category data under UK GDPR. We only use it to create and deliver your plans, with your explicit consent, which you give in the intake form. Our Privacy Notice explains what we collect, who processes it, how long we keep it, and how to exercise your rights.

12. Complaints and disputes

12.1 If you are unhappy, please email [email protected]. We aim to reply within 5 working days and resolve complaints within 14 days.

12.2 These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.

13. Other important terms

13.1 If a court finds part of these terms unenforceable, the rest still applies. If we delay enforcing these terms, we can still enforce them later. Only you and we have rights under this contract.
